I received this email last night from healtech:
Hi Steve,
I have some good news already:
1) We have managed to solve the problem and the GPDS-D02 (C09) is in production now.
It will be in US stock in about 10 days.
I think you deserve an explanation what was wrong with the C08:
Initially we got a new Scrambler for testing from a Ducati dealer which is 300 miles away.
The bike was so new, it had 0 miles in the clock and did not have papers and license plate. So we were asked to test it on a rear stand only. We made the C08 and it was working perfectly on the stand.
After your report, we borrowed this bike again and we managed to road test it this time. It turned out Ducati changed the communication protocol on this bike and they put the front+rear wheel speed info into one data packet. So when the front wheel was turning, it screwed things up. This is why you also had no problems when the unit was tested on a rear stand.
I can assure you the C09 will work perfectly both on the stand and on the road

So for those of us that have the unit installed, the seller will need to replace the current unit. If you paid for installation service, it hurts although they did offer me a discount on the QSE (quick shifter unit if I wanted to add that also) for my troubles. I am satisfied with the response.
